2. Hosting
The site is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, United States. It runs in the Frankfurt region (Germany).
3. Responsible for publication
SPTS - Swiss Payroll & Tax Services Sàrl.
4. Licences
SPTS is licensed by the Canton of Geneva and by SECO for staff leasing and recruitment, in Switzerland and abroad.
- Cantonal licence, issued by the Geneva Cantonal Office for Labour Inspection and Relations (OCIRT): staff leasing and private recruitment in Switzerland.
- Federal licences, issued by the State Secretariat for Economic Affairs (SECO) in addition to the cantonal licence: staff leasing from Switzerland to other countries, and private recruitment between Switzerland and other countries.
These licences are listed in the federal register of licensed companies, which identifies SPTS by its legal name and IDE. They do not carry a number.
5. Our services
Under the SPTS Portage name, SPTS offers:
- staff leasing, including in the form known as Employer of Record: SPTS employs the worker and places them with a company that directs their work;
- payrolling: SPTS employs a consultant who carries out an assignment for a client company, within the framework of staff leasing;
- payroll services: the client company remains the employer and entrusts SPTS with preparing its employees' payroll;
- collaboration with recruitment agencies, which introduce to SPTS consultants whom SPTS employs itself.
Details of these services, their conditions and each party's responsibilities are set out in the terms and conditions.
6. Nature of the information published
The information on this site covers payrolling, staff leasing, social insurance, withholding tax and employment law in Switzerland. It is general in scope: it describes the rules and how they usually apply, without taking your particular situation into account. It is neither personalised legal, tax or social security advice, nor an offer, and it does not replace an analysis of your situation.
The applicable rules vary according to the canton, the permit, family circumstances and the nature of the assignment. Rates, thresholds and tariffs change, in particular on 1 January; where figures are given, they are dated on the site.
We take care to update the information published as regulations change. A change may nevertheless occur between two updates: before taking any decision, consult the official sources or ask us to analyse your situation. We correct any errors we become aware of.
7. Simulations
Salary and employer cost simulations are indicative estimates. They are based on the data you enter and on the calculation assumptions used, and on the rates and tariffs known on the date of the simulation.
Each simulation shows its date, the assumptions used and the items it does not take into account. The result depends in particular on your canton of work, your permit, your family circumstances, your age and the amount actually invoiced in the month.
The estimated net salary is not a term of employment. Your salary terms are those of your employment contract. The net amount actually paid may differ from the estimate and vary from month to month, in particular depending on the amount invoiced, absences, or a change in rates, tariffs or your situation.
A simulation is neither an official decision nor a guarantee of the decisions of the authorities. The withholding tax tariff and social security contributions are set by the competent authorities and institutions; SPTS applies them, does not set them, and a correction by the authority remains possible. Nor is a simulation an offer or a contractual commitment.
SPTS checks the calculations of its simulation tools. When it becomes aware of an error, it corrects it.
8. No contract without a signed written contract
Visiting this site, or sending a form, a simulation request, an email or a message, does not create any employment contract, staff leasing contract or engagement. Only a written contract signed by SPTS and the other party counts.
An assignment cannot start before the employment contract and the staff leasing contract have been signed and, where a work permit is required, before the authority has decided.
Signature. During a transitional period, documents for which written form is required, in particular the worker's employment contract and the staff leasing contract, are signed by hand.
9. Electronic communications
An email, a form or a message does not guarantee that your request is received or that a deadline is met. For any step subject to a deadline, make sure that we have confirmed receipt of your request.
For a first contact or a simulation request, simply describe your situation: do not send sensitive documents through the form, by email or by WhatsApp, in particular an identity document, a permit, a medical certificate, a salary certificate or your bank details (IBAN).
If you become a consultant, these documents are uploaded to your consultant portal, which is reserved for your file. Emails are encrypted in transit where the email services allow it, but not end to end.
WhatsApp is used for practical exchanges with people who choose this channel. What its use involves is described in our data protection policy.
10. Consultant and client portals
The consultant and client portals are reserved for people to whom SPTS has granted access. Each user sees only the documents that concern them.
Your login details are personal. Do not share them with anyone, and report any use you did not make to portage@spts.ch without delay. SPTS may suspend access in the event of misuse or a security risk.
11. Use of the site
The site is free to access.
You undertake to send through the site only accurate information that concerns you or that you are authorised to disclose. Do not send a third party's data, for example your spouse's, without informing them.
You may not use the site in any way that would compromise its operation or security, in particular by attempting to access non-public areas or a portal without authorisation, extracting its content by automated means, sending mass requests or transmitting malicious content.
12. Intellectual property
The content of this site, in particular its texts, images, graphic elements, simulation tools and structure, is protected under the applicable intellectual property provisions. It belongs to SPTS or to third parties who have authorised its use; photographs are used under licence.
The content may be viewed and printed for personal use or to assess SPTS's services. Any other reproduction, distribution or commercial use requires the prior written consent of the rights holder, subject to uses permitted by law, in particular the right of quotation.
The names "SPTS" and "SPTS Portage" and the associated logos belong to SPTS. Third-party trade marks, logos and names mentioned belong to their respective holders; their presence on the site confers no right to use them.
13. Liability
The information and simulations on this site have the scope described in sections 6 and 7: they are general or indicative, and take your situation into account only once we have examined it with you. An important decision, for example accepting an assignment, leaving a job or applying for a permit, should be based on your contract and an analysis of your situation, not on a page or a simulation alone.
This section concerns the use of the site. SPTS's liability in providing its services is governed by the terms and conditions and by the signed contract.
14. External links
This site contains links to external sites, in particular authorities, official sources and public registers, as well as to WhatsApp. These sites and services are the responsibility of their operators. We control neither their content nor their availability.
15. Availability of the site
We do not guarantee that the site and the portals are accessible at all times and without interruption, in particular during maintenance or an outage at a technical service provider. We may change the site or suspend access to it at any time.
16. Data protection and cookies
Our data protection policy describes what data we process, for what purposes, to whom we disclose it and how long we keep it. Our Cookies page describes what the site stores in your browser and lets you change your preferences. For any question: portage@spts.ch.
